The types of data collected include Usage Data (such as pages visited, time spent on the site, and navigation paths), Device Information (including device type, browser type, and operating system), Location Data (general geographic location derived from anonymized IP addresses), and Interaction Data (such as clicks, scrolling patterns, and heatmaps).

3.3 Information Collected Through Affiliates: Forage may collect data from datasets belonging to its current or future parent companies, subsidiaries, or other entities under common ownership or control. This information may be utilized to enhance our Services and overall operations.

3.4 Sensitive Personal Information: Forage AI does not engage in the collection of Sensitive Personal Information, as defined by applicable privacy laws. The users acknowledge that such processing is carried out in accordance with Article 6 (1) (f) of GDPR in so far as it relates to users from the EU, which allows processing based on legitimate interests and that these interests are carefully assessed to ensure they do not override the users’ rights to privacy and data protection. The information collected through the Website or as mentioned hereunder is strictly limited to contact, message/requirements/ purpose of connection information and technical data for the purpose of communication and enhancing user experience. 

6. WITHDRAWAL OF CONSENT:

However, if you withdraw your consent, we may, without prejudice to any other rights available to us, terminate your account/access and will not be liable for any consequences arising therefrom.

7.1.1.4 Urchin Tracking Module Parameters: Urchin Tracking Module (“UTM”) parameters are customizable tags appended to URLs to track the source, medium, and campaign driving traffic to a website. They allow organizations to monitor the effectiveness of marketing campaigns and analyze visitor behavior by capturing specific details about the referral source. Data collected through UTM parameters is processed in compliance with applicable privacy laws and is typically used in conjunction with analytics tools to enhance campaign performance and reporting.

7.1.1.5 Forage AI is also using 6 sense sales intelligence and another tool viz., RB2B for the purpose of tracking and collecting user data based on the tools offering.

7.2 Forage AI collects non-essential data through cookies, Google Tag Manager and UTM parameters only after obtaining explicit user consent. This approach aligns with Forage AI’s commitment to compliance with GDPR and other applicable data protection laws.

8. DATA CONTROLLER AND DATA PROCESSOR

8.1 Data Subject” is any identified or identifiable natural person, whose personal data/information is processed by the Controller responsible for the processing.

8.2 Article 4 (7) of the GDPR defines the term “Controller” as the natural or legal person, public authority, agency, or other body that, either alone or jointly with others, determines the purposes and means of processing personal data. 

8.3 Article 4 (8) of the GDPR defines the term “Processor” as a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.

8.4 FORAGE AI AS A CONTROLLER

8.4.1 Forage AI acts as a Data Controller when we collect and use personal data of Data Subjects who visit our Website as well as when we gather and utilize information for the purposes of developing and maintaining our database and providing our Services.

8.5 FORAGE AI AS A PROCESSOR

8.5.1 When our Customers use our Services, they act as the Data Controller and are responsible for ensuring that the personal data they collect is processed lawfully. In such cases, Forage AI acts as the Data Processor, receiving personal data solely for processing on behalf of our Customers, as per their instructions. Our Customers are solely responsible for determining the purposes and means of processing and for ensuring that any third-party individuals who interact with a website, application, or service utilizing our Services are informed about the processing of their personal data. This includes obtaining necessary consents, where applicable, and ensuring compliance with all relevant applicable laws including GDPR concerning the collection, use, and processing of personal data through our Services. Forage AI’s obligations regarding personal data for which we act solely as a Data Processor are governed by the terms of our agreements with our Customers and are not addressed in this Privacy Policy.

9. ACCESS CONTROL AND AUTHORIZATION FOR PERSONAL DATA

9.1 Access to personal data at Forage AI is meticulously controlled and restricted to ensure confidentiality, integrity, and compliance with applicable data protection regulations.

10.1.2 We use standard encryption protocols to protect personal data during transmission. Data stored on AWS is secured with appropriate access controls. While Forage AI follows industry best practices for managing user data, we do not claim specific security practices like multi-factor authentication, encryption of data at rest, or detailed access controls unless explicitly provided by AWS or third-party providers.

10.1.3 Our website is regularly monitored to ensure security and prevent unauthorized access, and we take steps to comply with privacy regulations, including those related to the California Consumer Privacy Act (CCPA).

10.1.4 Forage AI follows AWS’s guidance for securing hosted data and ensures that its website and associated systems comply with necessary security protocols within the AWS environment.

11. STORAGE OF PERSONAL INFORMATION

11.1 The personal data collected by Forage is stored in compliance with applicable US data protection regulations on servers managed by trusted third-party service providers. Such data is hosted on secured servers typically located within the United States or in jurisdictions that adhere to standards equivalent to U.S. data protection and privacy regulations. 

11.2 Forage ensures that all hosting providers and third-party service providers implement stringent safeguards to protect personal data, including advanced encryption methods, robust access controls, and continuous monitoring to prevent unauthorized access, alteration, or disclosure. Additionally, data processed through third-party tools, such as Google Analytics, Hotjar, and email service providers, is stored within secure infrastructures managed by these entities and governed by their respective data protection policies. 

12 DATA RETENTION AND DATA DELETION: 

12.1 Forage retains personal data as is necessary to fulfill the specific purposes for which it was collected as well as for communication purposes, consistent with applicable legal, operational, and business requirements until the user specifically requests in writing otherwise. 12.2 Contact Information: Personal data, including but not limited to name, email, and message content, is retained solely for the duration necessary to respond to inquiries, provide services, or otherwise fulfill the purpose for which the data was initially collected and generally until the user specifically requests in writing otherwise. We will respond to your request by mail within 45 (Forty five) days which may extend by an additional 45 (Forty five) days if necessary, with notice provided. In case we are unable to fulfil your request, we will inform you of the reasons within the same timeframe, along with instructions on how to appeal our decision.

2.7 Right to Appeal: In case  we decline your request to exercise any of the above rights, you have the right to appeal the decision by reaching out on compliance@forage.ai. If your appeal is denied, you may contact the Attorney General of Colorado.

SUPPLEMENTARY POLICY FOR USERS RESIDING IN THE EUROPEAN UNION:

This Policy supplements our Privacy Policy and applies to individuals residing in the European Union, outlining the rights applicable to you under GDPR. 

1. RIGHTS UNDER GDPR:  

1.1 Right to Access:  Each Data Subject has the right to obtain, at any time, free information from Forage regarding the personal data stored about them, as well as a copy of this information. In addition, Data Subjects are entitled to the following information:

  • The purposes of the processing;
  • The categories of personal data concerned;
  • The recipients or categories of recipients to whom the personal data have been or will be disclosed, particularly recipients in third countries or international organizations;
  • The envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • The existence of the right to request the rectification, erasure, or restriction of processing of personal data, or to object to such processing;
  • The right to lodge a complaint with a supervisory authority in accordance with Article 77 of GDPR; 
  • Where the personal data was not collected from the Data Subject, any available information as to its source;
  • The existence of automated decision-making, including profiling, as defined in Article 22(1) and (4) of the GDPR, and at least in such cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the Data Subject;
  • Information on whether personal data is transferred to a third country or an international organization, and where applicable, details of the appropriate safeguards. 

1.2 Right of Confirmation:
Each Data Subject has the right, as granted by the European legislator, to obtain from the Controller confirmation as to whether or not their personal data is being processed. Should a Data Subject wish to exercise this right of confirmation, they may contact Forage. 

1.3 Right to Rectification:
Each Data Subject has the right to obtain, without undue delay, the rectification of inaccurate personal data concerning them. Furthermore, the Data Subject may complete any incomplete personal data, including by providing a supplementary statement, if necessary. 

1.4 Right to Erasure (Right to be Forgotten):
Each Data Subject has the right to request the erasure of personal data concerning them without undue delay, where one of the following grounds applies, unless the processing is necessary for compliance with a legal obligation or for the establishment, exercise, or defense of legal claims:

  • The personal da ta is no longer necessary for the purposes for which it was collected or processed;
  • The Data Subject withdraws consent, and there is no other legal basis for processing;
  • The Data Subject objects to processing and there are no overriding legitimate grounds for processing;
  • The personal data has been unlawfully processed;
  • The personal data must be erased to comply with a legal obligation under Union or Member State law;
  • The personal data was collected in relation to the offer of information society services to children.

Where applicable, and if a Data Subject requests the erasure of personal data, Forage will take immediate steps to ensure compliance, including communicating the erasure request to other controllers where necessary. 

1.5 Right to Restriction of Processing:
Each Data Subject has the right to obtain restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested, for a period enabling Forage to verify the accuracy of the personal data;
  • The processing is unlawful, and the Data Subject opposes the erasure of personal data and requests instead the restriction of its use;
  • Forage AI no longer needs the personal data for processing purposes, but it is required by the Data Subject for the establishment, exercise, or defense of legal claims;
  • The Data Subject has objected to processing, pending verification as to whether the legitimate grounds of Forage override those of the Data Subject.

1.6 Right to Data Portability:
Each Data Subject has the right to receive the personal data concerning them, which was provided to Forage, in a structured, commonly used, and machine-readable format. The Data Subject also has the right to transmit these data to another Controller without hindrance. This right applies when processing is based on consent or contract and is carried out by automated means.

Data Subjects are entitled to request the direct transmission of their personal data to another Controller where technically feasible, provided such transmission does not adversely affect the rights and freedoms of others. To exercise the right to data portability, Data Subjects may contact Forage at the contact details provided herein. 

1.7 Right to Object:
Each Data Subject has the right to object, on grounds relating to their particular situation, to the processing of personal data concerning them, where processing is based on legitimate interests or public tasks. This right also applies to profiling based on these legal grounds.

If personal data is processed for direct marketing purposes, the Data Subject has the right to object at any time to the processing of personal data for such marketing, including profiling related to such marketing. In such cases, Forage will immediately cease processing the personal data for these purposes.

Furthermore, Data Subjects have the right to object to processing for scientific or historical research purposes or statistical purposes, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

1.8 Automated Individual Decision-Making, Including Profiling:
We may use automated tools for sending personalized emails to Data Subject as well as responding to emails and the Data Subject consents to the use of such automated tools. Each Data Subject has the right not to be subject to decisions based solely on automated processing, including profiling, which significantly affects them, unless:

  • The decision is necessary for entering into or performing a contract between the Data Subject and Forage AI;
  • The decision is authorized by Union or Member State law, which includes appropriate safeguards for the Data Subject’s rights;
  • The decision is based on the explicit consent of the Data Subject.

Where such decisions are based on consent, Forage will ensure appropriate safeguards are in place, including the right to obtain human intervention, express the Data Subject’s point of view, and contest the decision.
